Terms & Conditions

Welcome to Altitude Drone Services ("ADS"). By requesting a quotation, making payment, booking a service, or making use of any service provided by ADS, you acknowledge that you have read, understood and accepted the following Terms & Conditions.

1. Flight Time

Drone flight time is based on battery usage.

Each service package includes the number of batteries specified within the selected package. Actual flight time may vary depending on weather conditions, wind speed, flight style, payload, battery health and operational requirements.

We monitor battery performance before and during every flight to maximise safe and effective flight time. While every effort is made to achieve the advertised flight duration, battery performance cannot be guaranteed due to factors beyond our control.

Should the Client request additional flight time beyond the selected package, the additional flight time will be quoted and must be paid immediately before the extended flight commences. A valid Proof of Payment (POP) must be received by Altitude Drone Services before any additional flight time is undertaken.

2. Flight Safety & Pilot in Command (PIC)

The Pilot in Command (PIC) has the final authority regarding all drone operations.

Altitude Drone Services reserves the right to delay, postpone, modify or cancel any flight if conditions are considered unsafe or if the operation would breach South African Civil Aviation Authority (SACAA) regulations.

The safety of people, property and the aircraft will always take priority over completing any flight.

Should a flight be cancelled on-site due to unsafe weather conditions, safety concerns, permission issues, restricted airspace, or any circumstance beyond the reasonable control of ADS, a cancellation fee shall apply.

The cancellation fee will be the greater of: R250 (minimum); or 10% of the total package value. Where 10% of the booking value exceeds R250, the 10% value shall apply. This cancellation fee includes travel costs already incurred by ADS.

3. Weather & Flying Conditions

All drone operations are weather dependent.

Flights may be delayed, postponed or rescheduled due to, but not limited to: rain, strong winds, lightning, low cloud, poor visibility, excessive dust or smoke, extreme temperatures, or any condition considered unsafe by the Pilot in Command.

Weather-related postponements do not constitute cancellation of the booking.

Where conditions permit, the booking may be rescheduled to the next mutually available date.

4. Airspace Restrictions

All drone operations are conducted in accordance with South African Civil Aviation Authority (SACAA) RPAS regulations.

Certain locations require additional approvals before drone operations may legally take place. This includes, but is not limited to: airports, airfields, helipads, controlled airspace, restricted or prohibited airspace, military facilities, national key points and other regulated locations.

Where additional approvals are required, these may result in scheduling delays and/or additional costs.

5. Site Safety

The Client agrees to provide a reasonably safe operating environment.

ADS reserves the right to refuse or suspend operations where hazards exist, including but not limited to: unsafe terrain, construction hazards, trees, power lines, cranes, moving vehicles, crowds, aggressive persons, dangerous animals, or any condition considered unsafe by the Pilot in Command.

6. Permissions

The Client is solely responsible for obtaining all permissions required from property owners, estate management, venue operators, body corporates, municipalities or any other relevant authority before the scheduled booking.

Should a flight be interrupted, suspended or terminated due to permission issues or access restrictions, the Client remains liable for the full booking value.

Should the Client wish to complete the remaining work on another day, a new booking may be arranged and additional travel charges shall apply.

Altitude Drone Services accepts no responsibility for delays or cancellations resulting from unavailable permissions or restricted access.

7. Booking Confirmation, Payments & Cancellations

Booking requests will only be processed once full payment has been received and reflects in the Altitude Drone Services business account, unless otherwise agreed in writing.

Payment secures your booking request; however, bookings remain provisional until confirmed by ADS.

Following payment, ADS will review the requested date, time and operational requirements before confirming availability. Should the requested date no longer be available, ADS will offer the next mutually available alternative.

Clients may choose to: accept the alternative booking date; credit the payment towards a future booking; or request a full refund where no suitable alternative can be agreed upon.

Quotations remain valid for 30 calendar days from the date of issue.

Clients cancelling more than 48 hours before the scheduled booking will incur no cancellation fee and may choose either a full refund or a credit to their ADS account.

Cancellations within 48 hours of the scheduled booking may result in the applicable cancellation fee as described in these Terms & Conditions.

8. Editing & Delivery

Standard editing turnaround is approximately 5–7 working days, unless the Priority Editing (24–48 Hours) service has been purchased.

Final deliverables are supplied digitally.

USB Footage Delivery is an optional add-on purchased separately and is not included in standard package pricing.

Every project includes a complimentary 3-month Project Archive, commencing from the date of final media delivery.

Clients may purchase an additional 12-month Project Archive Extension.

While ADS makes every reasonable effort to retain project files, archive availability cannot be guaranteed beyond the selected archive period.

9. Client Responsibilities

The Client agrees to: provide accurate booking information; obtain all required permissions before the scheduled booking; ensure safe access to the property; inform ADS of any hazards before arrival; ensure the Pilot in Command can safely conduct flight operations without unnecessary risk; ensure the operating area is reasonably free from hazards that may endanger the Pilot, members of the public, surrounding property or the aircraft; and ensure any individuals appearing in promotional media have provided the necessary consent where applicable.

10. Liability

Altitude Drone Services is licensed and insured for the services described within the accepted quotation.

Liability is limited to the total value of the booking.

ADS shall not be liable for indirect, consequential or incidental damages arising from weather delays, regulatory restrictions, equipment failure beyond reasonable control or any circumstances outside the reasonable control of ADS.

11. Portfolio & Marketing

Unless otherwise agreed in writing, Altitude Drone Services reserves the right to use selected photographs and video footage for portfolio purposes, website, social media, marketing material and promotional campaigns.

Where the Client has purchased the Confidential Project Add-on, ADS shall not publish, distribute or use any project media for marketing, portfolio, website or social media purposes.

All project media will remain strictly confidential and will only be supplied directly to the Client.

12. SkyPoints Rewards Programme

Clients earn SkyPoints on qualifying completed bookings.

Additional SkyPoints may also be earned through successful client referrals, promotional campaigns, competitions, special offers, loyalty rewards and other reward opportunities introduced by ADS.

SkyPoints may only be redeemed on eligible additional services, package upgrades and other qualifying rewards as determined by ADS.

SkyPoints have no cash value, are non-transferable, may not be exchanged for cash, and do not expire. They remain linked to the Client's ADS account for the lifetime of the account unless removed due to fraudulent activity or misuse.

ADS reserves the right to adjust or revoke SkyPoints obtained through abuse, duplicate accounts, fraudulent activity or system misuse.

13. Force Majeure

Altitude Drone Services shall not be liable for delays, cancellations or inability to perform services due to circumstances beyond its reasonable control, including but not limited to: severe weather, airspace closures, government restrictions, civil unrest, natural disasters, power failures, equipment failure beyond reasonable control, medical emergencies, or any unforeseen event outside the reasonable control of ADS.

14. Right to Refuse Service

Altitude Drone Services reserves the right to refuse, postpone or terminate any booking where: safety may be compromised; aviation regulations would be breached; required permissions have not been obtained; the Client requests unsafe or unlawful operations; or the Pilot in Command determines that the flight cannot be safely completed.

15. Pricing & Terms Updates

Altitude Drone Services reserves the right to amend its pricing, service packages, additional services, SkyPoints Rewards Programme, policies and these Terms & Conditions at any time without prior notice.

Any amendments shall not affect quotations that have already been accepted and fully paid for prior to the changes taking effect.

The latest version of these Terms & Conditions will always be available on the Altitude Drone Services website.

16. Acceptance of Terms

By requesting a quotation, accepting a quotation, making payment, booking a service, or making use of any service provided by Altitude Drone Services, the Client confirms that they have read, understood and accepted these Terms & Conditions in full.

17. Equipment Failure

In the unlikely event of equipment malfunction, technical failure or any unforeseen issue that prevents ADS from completing the booked services, ADS will make every reasonable effort to reschedule the booking at the earliest mutually convenient date.

Where the service cannot reasonably be completed, the Client shall be entitled to either a partial or full refund for the affected portion of the booking.

ADS shall not be liable for indirect or consequential losses arising from such events.
